Terms and conditions of use

Access to and browsing of the MAPSTR application (hereinafter, the "Application") and use of the services provided by Mapstr SAS are governed by the general terms and conditions of use ("GTCU") detailed below.

The Application is the exclusive property of Mapstr SAS with capital of €57,368.13, registered with the Versailles Trade and Companies Registry under SIREN number 799 917 380, and whose registered office is located at 43, rue Pierre Valette, 92240 Malakoff.

The application was registered with the CNIL on January 9, 2014, under number 1794683.

Preamble

All users of the Application acknowledge that they have read and accepted these GTUs. Use of the Application implies unreserved acceptance of the GCU.

If you do not agree with all or part of the GCU, you must immediately refrain from using the Application. Mapstr SAS reserves the right to modify the GTU at any time and without notice. Modifications shall take effect immediately upon publication of the modified terms on the Application.

If a condition is missing in the present GTU, it will be considered as being governed by the practices in force in the distance selling sector, in accordance with French law.

Definitions

Application: refers to the mobile application published and operated by Mapstr SAS. GCU: refers to the present general terms and conditions of use of the Application.

User Content: refers to data transmitted by the User in the various sections of the Application.

Navigation data: refers to information relating to your terminal's connection to the Application. We may use this browsing data for statistical purposes.

Personal data: refers to information relating to Users. This may include the User's history of use of the Services.

Partners: refers to all e-commerce sites or IT companies with which we have a direct or indirect partnership contract.

Services: refers to all paid or free services available to Users.

User(s): refers to one (or all) person(s) registered on the Application Mapstr : refers to the SAS with capital of 30,780 euros which publishes the Application.

Access to services

The services offered by Mapstr via the Application include, among others:

- add and save geolocated addresses,

- identification of a Place by name, Place, contact details and tags defined by the User,

- display of the User's location and registered addresses.

The Services are accessible free of charge to any User with Internet access. All costs relating to access to the Services, whether hardware, software or Internet access, are the sole responsibility of the User. The User is solely responsible for the proper functioning of his/her computer equipment and Internet access.

Mapstr reserves the right to refuse access to the Services, unilaterally and without prior notice, to any User who fails to comply with these Terms of Use. Mapstr shall have no obligation to retain any information stored in our database relating to your account, or to transmit any such information to you or any third party.

Mapstr uses all reasonable means at its disposal to ensure quality access to the Services, but is under no obligation to do so.

Mapstr cannot be held responsible for any network or server malfunction or any other event beyond reasonable control, which prevents or impairs access to the Services.

Mapstr reserves the right to interrupt, temporarily suspend or modify without notice access to all or part of the Services, in order to carry out maintenance, or for any other reason, without the interruption giving rise to any obligation or compensation.

Limitation of liability

The User acknowledges having read and accepted these conditions, as well as having the skills to navigate the mobile application.

The User is solely responsible for the User Content he/she places online via the Services, as well as for the texts and/or opinions he/she formulates. In particular, he/she undertakes to ensure that such data does not infringe the legitimate interests of any third parties whatsoever. In this respect, he/she guarantees Mapstr SAS against any recourse, based directly or indirectly on these comments and/or data, that may be brought by anyone against Mapstr SAS. In particular, he/she undertakes to pay any sums resulting from a third party's action against Mapstr SAS, including legal fees and court costs.

Mapstr reserves the right to delete all or part of the User Content, at any time and for any reason whatsoever, without prior warning or justification. The User may not make any claim in this respect.

Mapstr reserves the right to exclude a User if his/her behavior on the Application is inappropriate. Mapstr also reserves the right to access, read, retain or disclose any information as necessary to satisfy any law, regulation, legal process or governmental request for the purpose of enforcing these Terms, including investigating potential violations of these Terms, detecting, preventing or reporting fraud, security or technical issues, responding to User requests for support, or protecting the rights, property or safety of mapstr, its Users and the public.

The Application provides certain address information from sources deemed reliable. However, Mapstr cannot guarantee the accuracy or relevance of this data. Furthermore, the information provided on the Application is for information purposes only and does not constitute advice or a recommendation of any kind.

Mapstr cannot be held responsible for disputes between users of the Services and Partners.

The information and/or documents available on the application are subject to change at any time, and may have been updated. In particular, they may have been updated between the time they were downloaded and the time the User takes cognizance of them.

Consequently, Mapstr SAS cannot be held liable in any way whatsoever for the use of the information and content available on the Application. The User is solely responsible for the proper use, with discernment and spirit, of the information made available on the Application.

In addition, the User undertakes to indemnify Mapstr SAS for any and all damages arising directly or indirectly from the User's use of the Service.

Mapstr undertakes to take all necessary steps to guarantee the security and confidentiality of data transmitted.

The User acknowledges that he/she is aware of the limitations and constraints of the Internet and, in particular, recognizes that it is impossible to fully guarantee the security of data exchanges. Mapstr SAS shall not be held liable for any loss or damage arising from the transmission of any information, including the User's login and/or password, via the Service.

Mapstr SAS shall in no event, to the fullest extent permitted by applicable law, be liable for any direct, indirect, material or immaterial damages or losses of any nature whatsoever resulting from the unavailability of the Service or from any Use of the Service. The term "Use" is to be understood in the broadest sense, i.e. any use of the site whatsoever, whether lawful or not.

In general, the User undertakes to comply with all regulations in force in France.

Personal data and confidentiality

Personal data collected on Mapstr is done so in agreement with the User and is intended to improve the User's experience on the application or via the Services.

Mapstr reserves the right to collect various nominative and non-nominative data, in particular through the collection of cookies, with a view to improving the customer experience and the ergonomics of the application and Services, statistical analysis and customization of the Services.

Mapstr may be required to communicate user information anonymously for the purposes of renting / selling / making databases available, subject to prior agreement with the user.

The application may also include targeted advertising and offers. The types and extent of advertising are subject to change. In consideration of mapstr granting you access to use its Services, you agree that mapstr, or its third party suppliers and partners, may place advertising on The Application.

The application was registered with the CNIL on September 16, 2014, under number 1794683.

In accordance with the French Data Protection Act no. 78-17 of 06/01/1978, all users have the right to access, rectify and delete their personal data, and may object to it being processed and used for commercial purposes.

Copyright and intellectual property

The Application and all its content are governed by French and international copyright and intellectual property laws. The general structure of the Application, as well as the texts, graphics, images, sounds and videos making it up, are the property of Mapstr SAS or its partners. Any representation and/or reproduction and/or use, in whole or in part, of the content and services offered by the Application, by any process whatsoever, without the prior written authorization of Mapstr SAS is strictly forbidden and may constitute an infringement of copyright under articles L 335-2 et seq. of the French Intellectual Property Code.

Texts, graphics, images, sounds and videos uploaded and/or imported onto the application by Users remain the property of their authors.

Similarly, any user with a personal or professional website must obtain prior agreement from Mapstr SAS to place links to the Application or Services. Mapstr SAS cannot be associated with any user using techniques such as framing / inline linking, and any link pointing to the Application must be removed at the request of Mapstr.

Hyperlinks

Mapstr provides hypertext links to websites published and/or managed by third parties.

Insofar as no control is exercised over these external resources, the User acknowledges that Mapstr assumes no responsibility for the availability of these resources, and cannot be held liable for their content.

Applicable law and jurisdiction

The legal rules applicable to the content and transmission of data on and around the site are determined by French law. In the event of a dispute which cannot be settled amicably, the French courts within the jurisdiction of the Versailles Court of Appeal shall have sole jurisdiction.
